Facilities illegally erected in the vicinity of the electricity grids

Following the regular verifications of the power distribution system, E.ON Moldova Distribuţie has identified approximately 1.700 facilities that do not comply with the in force legislation regarding the conditions of these buildings’ coexistence with the distribution installations in the proximity. These facilities have been erected mainly in the rural area, without being granted a permit by our company.
Infringing the legal provisions regarding the location of buildings in the vicinity of the electricity distribution grids may lead to incidents with very serious consequences, sometimes causing both the injury or decease of persons and significant material damages.
The storage, handling of some materials and the building of facilities near the power distribution system increase the risks of electrocution accidents, fires or damages caused by the breaking of the poles or conductors. Furthermore, both the operation of the power distribution grids and the access to the installations for intervention purposes can be affected, with implications on the safety and continuity of the customers’ supply in a certain area.
Moreover, we mention the fact that the full responsibility for the consequences of failing to observe these legal requirements lies with the persons generating them.
Our company has notified the owners of these facilities and advised them on the need to abide by the legal requirements so as to avoid the occurrence of undesired events. In addition, E.ON Moldova Distribuţie has also submitted notifications with respect to these cases to the institutions assigned with monitoring and intervening for the compliance with the legal provisions in the field of construction.
According to the provisions of the Electricity Law No. 13 of 2007, Art. 46, the legal or natural persons are forbidden to:
- erect any kind of facility in the safety area of the power distribution installations, without the distribution operator’s approval of the facility location;
- carry out any kind of digging works or set up plantations in the safety area of the power distribution installations, without the distribution operator’s approval;
- store materials on the passageway and in the protection and safety areas of the installations, without the distribution operator’s approval;
- limit or restrict through fencing, building construction or any other way the distribution operator’s access to installations.
Our company would like advert to the obligation of complying with these legal provisions so as to avoid undesired events, with extremely serious consequences.
